ARTICLE 2 – SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE
2.1 These General Terms and Conditions of Sale ("GTCS") apply to the sale of Champagne Pink Distribution SAS products available on the Pink Distribution SAS website at the following address: https://pink-distribution.com, under the “Shop” section (hereinafter the "Website"), under the conditions defined below.
2.2 These GTCS fully govern the relationship between Pink Distribution SAS and the buyer (hereinafter "Buyer").
2.3 The GTCS made available to Buyers on the Website are regularly updated. The latest version of the GTCS applicable to the order is provided in PDF format when the order is confirmed by Pink Distribution SAS via an email to the Buyer.
ARTICLE 3 – ORDER
3.1 The products are available on the Website under the “Shop” section.
3.2 Each product or category of products offered includes an image, a description, and a displayed price.
3.3 The Buyer must select the available bottles/gift boxes and "add them to their cart."
3.4 After filling out the form with their first name, last name, email, address, and phone number, the Buyer will validate their cart, which corresponds to their order.
ARTICLE 4 – ORDER PROCESSING
4.1 Once a Buyer validates an order on the Website, the order will be processed by Pink Distribution SAS.
4.2 A confirmation email acknowledging receipt of the order will be sent to the Buyer, along with the GTCS in PDF format. The Buyer will be able to print the GTCS to keep them on a durable medium. This email will inform the Buyer of all applicable fees, including delivery costs.
4.3 The invoice and the general terms and conditions of sale will be sent via email once the order has been processed and shipped.
4.4 The estimated delivery period will be specified in the order confirmation email.
ARTICLE 5 – PAYMENT TERMS
5.1 Payment can only be made by credit card.
5.2 Pink Distribution SAS has implemented, via Stripe, the necessary measures to ensure the confidentiality and security of Buyers’ banking data and to secure payments.
5.3 The Buyer guarantees that they are the sole holder of the credit card used for payment if the transaction is made by phone.
5.4 The order will be shipped to the Buyer under the conditions defined in Article 7 after the payment has been successfully processed in the Pink Distribution SAS bank account.
ARTICLE 6 – PRICING
6.1 The selling prices listed on the Website are in euros and include Value Added Tax (VAT). Shipping costs are indicated on the Website during checkout.
6.2 Pink Distribution SAS may adjust the prices on the Website at any time without prior notice. The prices applicable to an order are those in effect at the time of purchase.
6.3 The Buyer must immediately notify Pink Distribution SAS of any errors in the payment details provided during the order process.
ARTICLE 7 – DELIVERY TERMS & TRANSPORTATION
7.1 Product delivery is available only within mainland France.
7.2 Products will be delivered to the address provided by the Buyer on the Website, as stated in the order confirmation email. This address can be a residential address.
7.3 If the Buyer provides an incorrect address, Pink Distribution SAS cannot be held liable.
7.4 Pink Distribution SAS is also not responsible for failed deliveries due to a third party or in case of theft. In such cases, the Buyer must seek liability from the carrier.
7.5 If an order is returned due to the Buyer's absence or failure to arrange a new delivery date with the carrier, Pink Distribution SAS’ Customer Service will contact the Buyer for a second delivery at no additional cost. If the order still cannot be delivered, the Buyer will bear the costs of re-shipping.
7.6 If an order is returned due to an incorrect or incomplete address, Pink Distribution SAS’ Customer Service will also contact the Buyer for a second delivery at no additional cost. If the delivery fails again, the Buyer will bear the cost of re-shipping.
7.7 The Buyer can track the delivery by contacting the Customer Service at the email address provided in these GTCS.
ARTICLE 8 – RETENTION OF OWNERSHIP
Ownership of the products is transferred only after Pink Distribution SAS has received full payment of all amounts due for the order.
ARTICLE 9 – PRODUCT UNAVAILABILITY
9.1 Products are offered for sale while stocks last, including during promotional campaigns.
9.2 If a product in a validated order becomes unavailable, Pink Distribution SAS will, at the Buyer’s choice, either (i) cancel the order and issue a refund or (ii) offer equivalent products at the same price, subject to stock availability.
ARTICLE 10 – ORDER RECEIPT
10.1 The Buyer benefits from the legal guarantee of conformity and the warranty against hidden defects, as provided by law.
10.2 If a Buyer believes they have received a defective or non-conforming product, they must contact Pink Distribution SAS within 14 days of receiving the order at contact@obeloprovence.com or via registered mail with acknowledgment of receipt at 21 Avenue de Champagne, 51200 Épernay, specifying the defect or non-conformity.
10.3 The Buyer must provide proof of the visible defects or anomalies.
10.4 If Pink Distribution SAS confirms the defect, they will provide instructions on how to proceed with a replacement or refund.
10.5 If an exchange is not possible, Pink Distribution SAS will refund the Buyer within 14 days of receiving the product.
ARTICLE 11 – RIGHT OF WITHDRAWAL
11.1 The Buyer has 14 days from receipt of the last product in the order to return it without justification.
11.2 Return shipping costs are the Buyer’s responsibility. The product must be returned within 14 days of notifying Pink Distribution SAS of the withdrawal.
11.3 Products must be returned in their original packaging, as they are fragile.
11.4 Refunds, including delivery costs, will be processed within 14 days of Pink Distribution SAS being informed of the withdrawal.
ARTICLE 12 – LIABILITY
12.1 The Buyer is solely responsible for ensuring their internet connection is secure before placing an order.
12.2 Pink Distribution SAS is not liable for indirect or consequential damages.
12.3 Pink Distribution SAS cannot be held responsible for failure to perform obligations due to force majeure or Buyer’s fault.
ARTICLE 20 – APPLICABLE LAW
These GTCS are governed by French law.
In case of a dispute, the Buyer agrees to attempt mediation before resorting to litigation. If no agreement is reached, the dispute will be submitted exclusively to French courts.
